1.1 A user must be 18 years of age or older.
2.1 The exchange of user handles is meant to be limited to non-acquaintance situations. Registrants and those listed as agents should strive to protect each other's identities from unintended scrutiny. This service is inherently unnecessary in various closely-knit communities and is generally not recommended in employment/education/faith-based settings.
3.1 A user’s handle is intended to be voluntarily offered. A registrant can feel free to defer from any affiliation to www.blinkdate.com.
3.2 As a matter of etiquette, one should not ask for another user’s handle.
3.3 If a user offers to give out his/her handle, it must be the correct one.
4.1 All sponsors warrant that they know their respective guests/members in enough detail, as to be able to answer a broad range of questions, honestly and frankly.
4.2 Sponsors should discuss at most 3 to 5 questions/issues to determine whether or not a meeting should be set up and the details of where and when it would take place. If the sponsor is unsure or does not know the answer to a given question, they may request time to revert with a proper response, preferably within a 24-hour period.
4.3 A sponsor may decide that the particular question(s) posed is/are offensive in nature and can decline and/or report such inquiries to our site for abuse-notification. Otherwise, an answer must be attempted.
5.1 All policies and pricing are subject to change without prior notice.
5.2 Our service reserves the right, without notice, to change the look, feel and format of the website.
5.3 All content on this Site is protected by all applicable International Copyright and Trademark Laws.
6.1 www.blinkdate.com reserves the right to refuse service.
6.2 Images submitted to this site become the sole property of www.blinkdate.com.
7.1 All registrants warrant that information provided in their profiles be completely true and representative of themselves.
7.2 A user may only register once.
7.3 A user may be assigned only one handle at a time.
7.4 To help ensure registration uniqueness, we offer registrants two ways to add identifying/biometric documentation to their account. The first way is to upload a voice/video sample to your account record either at the time of registration or at any time thereafter. The second way is to request a simple “declaration” of identity that is notarized. By sending us the contact details via e-mail of the notary witnessing such Declarations, the registrant is entitled to a $20 refund against fees paid, within about three weeks. These Declarations also enable the Change-Handle feature.
7.5 A user may serve as a sponsor for another user, but never for themselves.
8.1 All users and sponsors shall endeavor to act civilly at all times with mutual respect and decorum in public situations and in dealing between themselves and/or the general public, at risk of forfeiture of their registration/listing.
9.1 Should a dispute arise between a user/sponsor and www.blinkdate.com, the user/sponsor agrees to a resolution by arbitration at a venue in the county of the closest corporate office for our service.
9.2 Should a dispute arise between a user/sponsor and another user/sponsor based on information exchanged, our service will conduct an investigation. If a violation of our terms of use is confirmed, the status color of the user in violation on our Search section will be set to yellow. A second violation will result in the user’s profile deactivation.
9.3 Users are required to maintain a list of valid sponsors. www.blinkdate.com reserves the right to verify contact information for individuals listed as primary sponsors, either on its own through sampling or on the behalf of another user/sponsor. If the Primary Sponsor’s availability cannot be confirmed, the status color of the user in question on our Search section will be set to yellow.
10.1 This website is provided “as is” and contains no express, statutory or implied warranties, other than those clearly stated under our terms and conditions.
11.1 The content, organization, graphics, design, and other matters related to the Site are protected by all United States and international copyright laws and other proprietary laws, including but not limited to intellectual property laws. The copying, reproduction, use, modification or publication by you of any such matters or any part of the Site is strictly prohibited, without our express prior written permission. Unlawful copying will be considered infringement.
12.1 All sales are considered to be final.
13.1 Acceptance of Agreement. You agree to the terms and conditions outlined in this Terms and Conditions of use with respect to our site (www.blinkdate.com). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, free product samples or freebie offers or services provided by or listed on the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and at any frequency without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.
14.1 To the extent permitted by law, neither www.blinkdate.com nor its employees or agents are liable for, and users are not entitled to, any indirect, special, incidental or consequential damages. To the extent permitted by applicable law, a user's recovery from www.blinkdate.com for any direct damages will not exceed the price of the Service at issue. To the extent the preceding limitation of liability is deemed invalid under applicable law, www.blinkdate.com 's total liability in any event will not exceed USD 15,000 or the equivalent thereof. User will indemnify, defend and hold www.blinkdate.com harmless from any claims beyond the scope of this service.
